While any one can write their own Will or Power of Attorney, they are too crucial an issue to leave to chance.  Clearly worded instructions in your Will and Power of Attorney are important, as well as ensuring that these important documents are properly signed.

3 WILLS

Many people put off having a Will, but it is an important document.  By having a Will:

ü      YOU determine who receives your assets and under what circumstances

ü      YOU nominate the guardianship of young children

ü      YOU specify any particular gifts to your family and /or friends

! Powers of Attorney The Companion to your will 

A Power of Attorney is a document that enables YOU to appoint someone to handle your affairs and make decisions on your behalf, especially if you become mentally incapacitated.  There are various types of Powers of Attorney including specific Powers of Attorney, Medical Powers of Attorney and Enduring Powers of Attorney.

An ‘Enduring Power of Attorney’ is especially important.  If you do not have one and you become mentally incapacitated, then someone on your behalf will need to apply to the Courts to be appointed as your guardian.  This can be time consuming and costly.

What happens next?

We will prepare your draft Will and Power of Attorney promptly upon receiving your completed Will Instruction Sheet.  Upon completing the drafts, we will advise you and payment will then be due.  Once you have reviewed the documents, to ensure that they accurately reflect your instructions, they will be prepared for signing.


& PROBATE

If you have been unfortunate enough to lose a loved one, you will need to obtain legal advice to determine what must happen to wind up the deceased persons estate and distribute their assets in accordance with their Will.  The legal term to describe this is “obtaining Probate of the Will”.

Probate is obtained by the executor named in the Will.

To obtain Probate on your behalf we will need:

ü     The originally signed Will

ü     The death certificate

What will it cost me?

Unlike conveyancing, it is very difficult to provide a standard fixed fee for this work, as some estates are more complex than others. 

However, once we have more detailed instructions from you we can provide you with a reasonably accurate estimate of the fees that you will incur.
